As we reported on two weeks ago, the family of the late Sublime guitarist/vocalist Bradley Nowell questioned whether the founding Sublime rhythm section of bassist Eric Wilson and drummer Floyd “Bud” Gaugh should be allowed to perform as Sublime with new vocalist Rome Ramirez. At that time the family stated, “Prior to his untimely passing, both Bud and Eric acknowledged that Brad Nowell was the sole owner of the name Sublime. It was Brad’s expressed intention that no one use the name Sublime in any group that did not include him, and Brad even registered the trademark ‘Sublime’ under his own name.” District Court Judge A. Howard Matz agrees and today issued a preliminary injunction preventing the trio from performing as Sublime until the matter is definitively resolved (although the issuing of a preliminary injunction indicates that Judge Matz thinks the family will prevail in a formal trademark infringement hearing).
